This lecture analyses a broad range of legal concepts and transaction types on the basis of „failed investments“, many of which were widely reported by the media. This includes fraudulent investment fund structures; a number of bank resolutions and the numerous legal disputes to which they gave rise; and examples of balance sheet fraud and insurance fraud.
To establish and deepen participants‘ practical understanding of the relevant legal concepts and structures, such as international investment funds, bank resolutions, corporate law structures and some legal aspects of accounting, and to facilitate their practical application by students.
- Initially, the lecture’s programme will be presented, including the cases and main concepts tob e discussed
- This will be followed by an in-depth discussion of each case and the relevant legal concepts
- The presentation will be based on power-point slides
- Students will be encouraged to participate in the presentation, including by oral presentations of selected topics
- Participation in class (20%)
- Oral presentation (Referat) to be held in class (35%)
- 90‘ written exam to be held during the last day of the lecture (45%)
