Insolvency law is a subject which many students find difficult. This course offers a fresh approach to make the subject more accessible.

The course operates at beginners' level and requires no previous knowledge of insolvency law.

Students may reap synergies by attending this elective course jointly with the mandatory PI Insolvenzrecht, yet this is entirely at their discretion.

As added value, the course supports students in developing their English language skills, both in writing and orally.

Learning outcomes

The course enables students

  • to place insolvency in the wider context of commercial considerations about credit and risk;
  • to explain contractual and proprietary instruments to control risk;
  • to understand the functional problems underlying all insolvency law systems;
  • to apply English legal terminology expediently.
Attendance requirements

This course is ‘prüfungsimmanent’ (PI). Accordingly attendance is compulsory.

Absence for up to two hours (120 minutes) in total will be tolerated without the need to offer a justification.

Any further absence will be tolerated if the student can provide a reasonable justification supported by written evidence (e.g. medical attestation).

Teaching/learning method(s)

The course combines elements of a lecture with active participation from the students.

Students are encouraged to participate in a lively debate in class!

Assessment

25% participation in class

25% written homework (essay)

50% written exam (90')

optional participation in a group project (in lieu of written homework and final exam)
